Bribery

Bribery is the corrupt payment, receipt, or solicitation of a private favor for official action. For example, bribery occurs if someone pays a governor $1,000.00 for appointing a particular person to a government director position. The governor does not have to personally receive the money for it to be bribery. A bagman or bagwoman could be used. A bagman or bagwoman is a person who collects a bribe for a public official.

First Court Hearing

Typically, a criminal defendant's first court hearing is an arraignment before a judge or magistrate. An arraignment is an appearance in court where charges are formally read to a defendant. The judge or magistrate may also evaluate whether there was probable cause for an arrest, and may compel the prosecutor to allege additional facts to support the arrest. If probable cause is not established , the defendant must be released. If bail has not been set, it is often set at the same time as the arraignment. Bail is often granted in a standard amount, depending upon the crime charged.

In some jurisdictions, there is a subsequent "formal" arraignment, where the formal charges ("indictment" or "information") are presented to the defendant. These charges are drafted by the prosecutor, and may vary from an original charges that were drafted by the police.

A conspiracy is an agreement by two or more persons to commit an unlawful act. Conspiracy is a separate crime from the crime that is the object of the conspiracy.

In a criminal case evidence is used to prove or disprove the existence of an alleged fact. But what is evidence? Evidence is the collective mass of things, such as testimony,documents,and tangible objects, presented before a tribunal in a given dispute.

Reason for Absence
