The FairTax legislation will put more money in your pocket to personally "bail out" any company or person of your choosing because you will take home your entire salary and you are only taxed on new items that you purchase. Also, you will receive a rebate for any taxes that you pay for necessities, such as food, shelter and clothing. The FairTax is a winning piece of legislation that Belinda supports 100 percent and it is based upon the principles upon which this country was founded.

The economy is in crisis because unemployment and overarching debt levels pushed thousands of families into the position where they did not earn enough to cover their debts, especially since, due to the current income tax system, individuals were not allowed to take home their entire pay checks and corporate taxes were imposed on their employers. This burst the real estate bubble, crashed real estate prices, consumer spending and manufacturing.

The wall street financial industry is now bankrupt because of the lack of financial regulation, lax monetary policy and a symbiosis between government and the financial industry. When the Glass-Steagal act of 1933 was repealed at the end of the Clinton administration through the Gramm-Leach-Bliley Act it opened the gates to the financial industry's bankruptcy. Prior to the repeal of the Glass-Steagal Act the wall street banking industry was prevented from engaging in high risk investments, such as credit default swaps and derivatives, in order to protect the depositors of these institutions.

Since the repeal, the amount of outstanding derivatives has grown to approximately $530 trillion. This represents an amount that is impossible to settle. Thus, the wall street banks are hoarding the Troubled Asset Relief Program (T.A.R.P.) funds because of the derivative time bomb. As the underlying assets of these derivatives collapse the wall street banks' exposure to counterparty risk increases and will lead to the inevitable collapse of even more banks, thus reducing the availability of investment credit even more.

Thus, it is pointless and useless for the United States Treasury to hand over Floridians and other American taxpayers hard earned money to wall street banks and institutions that have no chance of redemption, unless that money is used to provide foreclosure relief, renegotiate mortgages and make new loans to home owners, individuals, and businesses.

As your United States Senator I will demand that any T.A.R.P. funds and federal stimulus or recovery assistance are used to benefit Floridians and the American people in general, and are not used by bankrupt wall street banks and other institutions to further enrich executives, pad executive bonuses, acquire other banks and pursue risky lines of business in merger activities, carbon trading and complex derivatives.

Stop the Attempt to Swindle the American People

If Wall Street is bailed out with taxpayers' money, it will represent a historic swindle of the American public. The sad fact is that even if the American people bail out Wall Street and the financial institutions, those same institutions will foreclose on Americans homes if they do not pay their mortgages! What an outrage that the American people are expected to bail out the financial institutions so that those same institutions can foreclose on homes and refuse to provide loans to the American people! There is no public interest in this proposed bail out of Wall Street and the financial institutions. The elected politicians must stop this attempt to fleece the American people. If they do not do so, they should not be re-elected.

As a candidate for the United States Senate in 2010, I am committed to representing the great people of Florida, and promoting what is in their best interest. If I was already representing the great people of Florida, I would do everything in my power to take full control of the financial system and impose order on banks, firms and markets. I would not relieve the major banks and investment firms of their worthless assets by forcing the American people to pay for such losses which amount to over 700 billion dollars. The American people must immediately mobilize to stop this bail out from going through because this is a life or death struggle for the life of the average American. If we allow this bail out to go through, our future generations will live in grinding poverty while the few super wealthy gaze down in disdain from their mansions and palaces.

Dollar Continues to Lose Value

As a candidate for the United States Senate I built my campaign around my support of the FairTax legislation that is currently before Congress. The FairTax continues to gain support as indicated below.

Linder, R-Duluth, announced he had reached 65 co-sponsors for his tax reform legislation, where income taxes would be replaced with a national sales tax. The latest supporters are Oklahoma Reps. Frank Lucas and Mary Fallin.

"We have seen extraordinary traction this year," Linder said in a press release. "Grassroots support across the nation is motivating (Congress) members to study the FairTax and decide whether they are going to be for the bill or against the bill. I certainly appreciate Rep. Fallin's support, although I cannot take credit for her signature; it was her constituency."

The FairTax is the most highly co-sponsored piece of tax reform legislation in the U.S. House of Representatives, out-numbering its closest competition, the Freedom Flat Tax, by 59 co-sponsors. Linder said the FairTax has more co-sponsors than any other piece of tax reform legislation proposed in over three decades.

"I believe this is just the beginning," he said. "I can't go anywhere anymore without someone asking me how the FairTax is doing. People are paying attention and they are looking for ideas in which to believe. The FairTax is one that really resonates and creates excitement. To the Florida Tax and Budget Reform Commission:

Please consider placing on the November 2008 ballot an amendment to the Florida Constitution that would replace all the taxes at both the State and Local levels
including property, tangible and intangible taxes with a retail sales tax to apply to all NEW goods and services, with NO exemptions.
This amendment should change the Florida tax system at the State and Local levels to a consumption tax basis patterned after the federal Fair Tax Bill (HR-25) including the prebate.
The conversion of the current, complicated, and sometimes unreliable system of taxation can and should be accomplished in a timely manner. The retail consumption tax would broaden and strengthen our tax base, thus providing a more stable and reliable form of revenue collection.
It would also relieve the homeowners, the business owners, and the average taxpayer of the threat of losing all that they have worked hard to build, i.e., their homes, their farms, and their businesses, to an unfair and archaic form of tax collection (our current system) that is based on Socialist principles.
We need to move to a more Capitalistic and stable form of revenue collection. A state based FairTax solution is that remedy. I strongly urge your consideration to this most sound economic proposal.
I am a business owner, a lawyer, and a homeowner and I want to do everything possible to rescue this country from the illegal shake down artists. We must end the current regressive system of taxation. Your serious consideration and action on this proposal is urgently needed.

The Sixth Amendment of the Bill of Rights to the United States Constitution specifies that a person shall have the right to a speedy and public trial, by an impartial jury of the State and district where the crime is alleged to have been committed. It also states that the accused has the right to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of Counsel for the defence.

Accessory after the fact and before the fact

A person who knows that a crime has been committed and who helps the offender try to escape arrest or punishment is an accessory after the fact. An accessory before the fact is a person who assists or encourages another to commit a crime but who is not present when the offense is actually committed.

What is an Arrest?

I was the first attorney to produce a television talk show about legal issues from A to Z, so I know a little about the television shows in which the law enforcement officer typically says "you're under arrest". However, for purposes of a defendant's rights under the laws of the United States, an arrest may occur long before those words are uttered. The courts have concluded that an arrest occurs when a person reasonably believes he is not free to leave due to the actions of law enforcement officers.

The timing of an arrest is significant because once an arrest is made, and before asking you any questions (other than your name and address), law enforcement officers must provide your "Miranda warning". The warning is as follows:

"You have the right to remain silent. Anything you say may be used against you in a court of law. You have the right to an attorney. If you can not afford an attorney, one will be provided for you."

However, even if the police officer does not read you your rights, the case may not be dismissed. The police officer does not have to read anybody their "rights" unless that officer wants to get a statement or confession from a suspect. If the officer does not want to record what you have to say and use it against you, he does not have to read you your rights.

If the police officer wants to ask you some questions other than your name and address, he must give you your "Miranda warning". It is important that you not answer the police officer's questions in a fruitless attempt to cooperate because this will make it more difficult for the defense attorney to defend the case at a later time.

Murder is an unlawful act that involves the killing of one individual by another. While the definition of the crime varies depending on the jurisdiction, the consequences of a murder conviction are severe. Many courts distinguish between murder, which is viewed as a premeditated crime, and manslaughter, a less serious offense.

Murder is considered to be one of the most heinous crimes. Hence,those accused of murder may face severe punishments including, but not limited to:
* Life imprisonment with/without parole
* Death penalty
*Fines and other punishments and penalties

The severity of the punishment is based on a number of factors, which include:
* prior criminal convictions
* status of probation/parole
* General community attitude towards the crime in question
* aggravating/mitigating circumstances

Murder defenses that may be used in a trial include: self-defense, insufficient proof or evidence, factual innocence, insanity, heat of passion,and more.

A Warrant Is Not Always Required

In an effort to enhance the lives of my clients and human beings in general, I will be devoting most of my blog to explaining criminal law issues, in the hope of one day eliminating the need for the criminal justice system as we know it today.

Remember, there are four main circumstances in which a warrant is not required for police to search your home: (1) Consent. If the person who is in control of the property consents to the search without being coerced or tricked into doing so, a search without a warrant is valid; (2) Plain View. If a police officer already has the right to be on your property and sees contraband or evidence of a crime that is clearly visible, that object may be lawfully seized and used as evidence.; (3) Search Incident to Arrest. If you are being arrested in your house, police officers may search for weapons or other accomplices to protect their safety, or they may otherwise search to prevent the destruction of evidence; (4) Exigent Circumstances. Emergency situations which excuse the particular procedure from being followed or enforced.

The Fascinating World of Criminal Law

What is a search warrant? A search warrant is a court order that allows the police to search a specific location for specified objects at a specific time. If a judge is convinced that there is "probable cause" of either criminal activity or contraband at a place to be searched, he or she will issue and sign a search warrant. However, if officers have a warrant to search your house, they don't get automatic authority to also search your car parked outside on the curb; or, if the object is a stolen refrigerator, they can't look through your shirt drawer.

In general, the law is very interesting, but I find criminal law to be the most fascinating because in many cases a person's life is at stake.

In American criminal law, one of the most popular defenses you can claim is self-defense. It is used in all types of cases. However, it is frequently used as a homicide defense and many times it is effective. The keys to proving self-defense are necessity, immediacy and gravity. You have to prove there is some type of grave danger, death or serious bodily harm. You have to prove it was immediate and there was no other option, making it necessary to fight back.

Even as a child, I loved murder mysteries. That is probably why, as a lawyer, one of my favorite legal specialties is criminal law.

I auditioned tonight for a role in a local play. It was great to get back to this part of my life, while continuing to remain focused on everything else that makes my life worth living. Remember, we are the inheritors of this earth.

I started modeling and acting when I was in my early twenties and I have continued to do so through the years. The Supreme Court made the correct decision when it ruled that race must not be taken into consideration when assigning students to schools. Contrary to what the liberals think, integration does not equal a quality education. In fact, since integration African American students' academic performance and graduation rates have declined significantly.

A person who is not committed to looking out for the best interest of the people will never again be elected President of the United States, because the people now understand that if a candidate's policies do not benefit them it is not in their best interest to elect such a candidate. The people running for President who refuse to address the important issues facing the American people (they know who they are) should immediately withdraw from the race. For example, during Thursday's Democratic candidates' debate, I will be surprised if any of the candidates spend even a minute on the most important issues facing us today-the deficit and the FairTax.

I attended several parties and I had a chance to do some sightseeing. Toronto has a large immigrant community. For example, in certain parts of the city immigrants such as the Chinese, comprise almost 100 percent of the population. There are only approximately 30 million Canadians, even though Canada is about the same size as the United States.

I'm in Toronto meeting with various individuals. I decided to rent a car so that it would be easier to get around. The highway system makes it relatively easy to drive here without getting hopelessly lost.
Most of the people seem to support Canada's national health care system, even though they are paying a minimum of 15 percent sales tax and about 35 percent income tax in order to support the system. I have heard numerous complaints about how easy it is to abuse the system by using another person's health card to receive benefits. To combat this problem Canada is now issuing health cards with the photograph of the person on it.
I oppose a national health care system for the United States because it would mean supporting medical care that is seriously flawed. Before the United States institutes national health care we must first correct what is seriously wrong with the medical care that is being provided. Once elected, I will move immediately to put in place a system that will ensure a high quality of life for everyone who wants it.

United States Senate candidate, Dr. Belinda Noah has filed for an emergency temporary restraining order to halt the U. S. Senate debates scheduled for October 23, 2006, and November 1, 2006. In an attempt to pre-select the winner of the U. S. Senate race, the debate organizers refused to invite Dr. Noah and the other Independent candidates to participate in the debate. They only invited the Republican and Democratic candidates.

The public is disgusted by the attempts of the debate organizers to pre-select the winner of the U. S. Senate race in contradiction of our democratic principles. The debate organizers are attempting to deny Dr. Noah and the other Independent candidates an opportunity to participate in a debate that they are planning to broadcast on the airwaves that are owned by the public. The broadcasters have been given free and exclusive licenses to use our airwaves, but only on the condition that they serve the public.

Americans Must Demand that the FCC Enforce the Fairness Doctrine

As the next United States Senator from Florida, in addition to ensuring the swift passage of the FairTax legislation, I will also fight to make sure that the Federal Communications Commission (FCC) enforce the Fairness Doctrine. The Fairness Doctrine ensures that broadcasters bring opposing points of view to their listeners. In doing so, the doctrine strikes an appropriate balance between the First Amendment interests and needs of broadcasters, and those of the listening public.

As an Independent candidate for the United States Senate, I have witnessed first hand the need for the Fairness Doctrine. For example, even though six candidates qualified to have their names on the ballot in Florida's general election for the United States Senate in 2006, the broadcast media has virtually ignored all of the candidates, except two. Thus, Ladies and Gentlemen, the broadcast media has effectively refused to present reasonable coverage of all sides of ballot issues. The big loser in this scenario is the public. Even though the public owns the airwaves, it is being deprived of information necessary to make informed decisions that effect our democracy.

Because of my background in mass communications, I have effectively overcome this unfair and illegal behavior by most of the broadcast media, but most candidates in my position are not able to do so.

However, one television station stands heads and shoulders above the rest, and that is the ABC affiliate (WFTS) in Tampa, Florida. WFTS has invited all of the candidates running for office in the Florida primary and general elections to come in for an interview to be broadcast locally. I call upon all broadcast media to follow the lead of WFTS and provide reasonable and fair covererage of all candidates for political office.

Also, I call upon them to provide balanced coverage of issues of public importance, such as the FairTax legislation that is currently before Congress. For the most part, there has been an utter failure to report on this important le3islation, even to the point of the Florida broadcast media refusing to report on the July, 2006, FairTax Rally that drew over 10,000 FairTax supporters to downtown Orlando, Florida.

Please contact the FCC and demand that the Fairness Doctrine be enforced now.

The Founders of this great country, America, established a Constitutional Republic that recognizes the unalienable rights of all men and women to their lives, their liberty, and their property, with minimal interference. These rights were eventually extended to all men and women, regardless of race, color, religion, or national origin.

John Adams, the chief architect of the United States Constitution wrote: "The Constitution was made only for a moral and religious people. It is wholly inadequate for the government of any other".

Thus, ladies and gentlemen, it was God's words that most inspired America's Founders in their gallant quest for freedom over 200 years ago. In the twenty first century we must honor God's law to enjoy economic prosperity and to avoid unnecessary taxation, regulation, wars, and poverty.

Of course, as a descendant of Florida's Native Americans, I understand that America had already been "founded" before the United States Consitution was written. In fact, the Seminole Indians of Florida, of which I am a descendant, are the only "unconquered" Native American group in the United States. However, I also understand that the people that reside in the United States today must abide by the laws of the United States, because the United States won the overall war against the Native American population and the British. "To the victor goes the spoils of war."

Hence, as your Florida U. S. Senator, I will abide by the Constitution that was inspired by God. In that vein, I will work tirelessly to ensure that no unnecessary governmental impediments preclude the proper functioning of our most important institutions, so that my constituents can pursue the economic prosperity that they deserve. Such institutions include marriage, family, and the church.
